Welcome to Momento (“Momento,” “we,” “our,” or “us”).
These Terms govern your use of all Momento services, including the Momento mobile application.
By accessing or using the Momento website or application, you agree to these Terms. If you do not agree, do not use the Service.
2. About Momento
Momento is a platform that helps people discover, share, and organize local events and experiences. The Service may include:
- Event listings aggregated from third-party sources
- User-submitted events
- Community features and social interactions
- Links to external ticketing or event services
Momento is a platform only. We do not organize, host, or control most events listed on the Service.
3. Eligibility
To use Momento, you must:
- Be at least 16 years old
- Have the legal capacity to agree to these Terms
- Provide accurate information
If you create an account on behalf of an organization, you confirm that you have authority to do so.
4. User Accounts
You may need to create an account to access certain features. You agree to:
- Provide accurate and up-to-date information
- Keep your login credentials secure
- Be responsible for all activity under your account
- Notify us of unauthorized use
We may suspend or terminate accounts at our discretion.
5. User Content
You may submit content, including event listings, photos, comments, and posts. You retain ownership of your content.
However, by submitting content, you grant Momento a non-exclusive, worldwide, royalty-free license to use, display, distribute, and promote that content within the Service.
You are solely responsible for your content. We may remove or moderate content at any time.
6. Community Standards
You agree not to:
- Post illegal or harmful content
- Harass or abuse others
- Promote hate or discrimination
- Share fraudulent or misleading events
- Spam or misuse the platform
- Violate intellectual property rights
We may remove content or suspend accounts for violations.
7. Event Listings & Accuracy
Events on Momento come from third parties and users. We do not guarantee the accuracy, availability, quality, or safety of events. Event details may change or be canceled at any time. You are responsible for verifying event information.
8. Third-Party Services & Ticketing
Momento may link to third-party services. We may earn affiliate commissions. Transactions occur between you and third parties.
We are not responsible for purchases, refunds, event changes, or third-party services.
9. Real-World Events & Personal Responsibility
Momento connects people to real-world events, which may involve risk. By attending events, you agree that participation is voluntary, you are responsible for your safety, and you assume all risks.
To the fullest extent permitted by law, Momento is not liable for injuries, losses, damages, or incidents occurring at events.
10. Promotions & Sponsored Content
Momento may feature promoted events or content. Promotions are displayed within the app and are based on activity within Momento. We do not sell your personal data or share it with advertisers.
11. Intellectual Property
All platform content (excluding user content), including logos, branding, software, and design, is owned by Momento or its licensors. You may not use our content without permission.
12. Platform Availability
We strive to provide a reliable Service but do not guarantee continuous availability or error-free operation. We may modify or discontinue features at any time.
13. SMS / Text Messaging
Momento may use SMS for phone verification and security (2FA). Standard messaging terms apply, including message/data rates. Opt out via “STOP” or contact hello@momento.global for help.
14. Termination
We may suspend or terminate your access if you violate these Terms, your activity harms the platform or users, or as required by law. You may delete your account at any time.
15. Disclaimer of Warranties
The Service is provided “as is” and “as available.” We make no warranties regarding accuracy, reliability, or availability. Use of the Service is at your own risk.
16. Limitation of Liability
To the fullest extent permitted by law, Momento shall not be liable for indirect or incidental damages, lost profits, personal injury, event-related issues, or third-party actions.
17. Indemnification
You agree to indemnify and hold Momento harmless from claims arising from your use of the Service, your content, or violations of these Terms.
18. Privacy
Your use of Momento is governed by our Privacy Policy.
19. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
20. Changes to Terms
We may update these Terms at any time. Continued use of the Service means you accept the updated Terms.
